Family of Kidnapped Sayed Alawi Responds to MP Al-Marafi: Prosecution Didn’t Tell us about Our Son’s Place

Bahrain Mirror: Family of kidnapped Sayed Alawi Sayed Hussein issued a statement responding to MP Mohammad Al-Marafi's in which he claimed that Sayed Alawi is suspended within an order from the Public Prosecution. The family said "How come that Sayed Alawi is suspended pending investigation and the prosecution hasn't unveiled yet his place and hasn't even replied to the lawyer's address or family's letter?"
The family condemned the statements of MP Al-Marafi and president of Human Rights Commission in the House of Representatives, who claims that he is closely following Alawi's case. The family bear him and the authorities the responsibility of Sayed Alawi's disappearance.
"The MP alleges that he is sure that Sayed Alawi is found at the Criminal Investigation Department and that he is suspended pending investigation," the family commented.
It continued "It is either that the MP is lying or the government's institutions are, as the family haven't received yet a call from Sayed Alawi and they know nothing about him until now. We contacted the competent parties in the ministry of interior and they denied that he is found there. Then, how come that Sayed Alawi is suspended pending investigation and how is he interrogated without the presence of his lawyer?"
The family further stated "We, the family of the kidnapped, call on the MP to go back to Bahrain's Constitution and to consider it more than once in order to understand some of the citizens' rights mentioned in it. The MP should know, if indeed he is specialized to look into the kidnapped case, that article 19 of the Constitution stipulated: (a) Personal liberty is guaranteed in accordance with the law.(b). No person shall be arrested, detained, imprisoned, searched or compelled to reside in a specified place, nor shall the residence of any person or his liberty to choose his place of residence or his liberty of movement be restricted, except in accordance with the law and under the supervision of the judicial authorities. (c). No detention or imprisonment shall be imposed in places other than those specified in the prison laws. In these places health and social welfare shall be observed, and they shall be subject to the supervision of the judicial authorities. (d). No person shall be subjected to physical or mental torture, enticement or degrading treatment, and the law shall provide the penalty for these acts. Any statement or confession shall be null and void if it is proved to have been made under duress or enticement or degrading treatment or threat thereof."
"Don't forget oh president of human rights commission in the House of Representatives that no punishment is to be issued unless pursuant to this law and that article 20 stipulates that (a). No crime or penalty may be established except by virtue of law, and no penalty may be imposed except for offenses committed after the relevant law has come into force. (b). Penalty is personal. (c). An accused person shall be presumed innocent until proved guilty in a legal trial in which the necessary guarantees for the exercise of his right of defense in all the stages of investigation and trial are ensured in accordance with the law. (d). No physical or moral injury shall be inflicted on an accused person. (e). A council for the defense of any person accused of a felony shall be appointed with the approval of the accused. (f). The right to trial shall be guaranteed in accordance with the law," the family went on to say.
It added "Doesn't this MP know that the kidnapped Sayed Alawi is a human being and a Bahraini citizens who enjoys all his rights? Doesn't he know that he was kidnapped from his work place without an official warrant? Doesn't he know that Sayed Alawi was not allowed to call his family since October 24? Doesn't he know that he has a wife and a 9-year-old boy who cries every day for his father?"
"We tell you MP to return to the Constitution's articles and to read them carefully maybe you can figure out what you are saying," the family announced.
The family bear MP Al-Marafi and the authorities the responsibility of kidnapping Sayed Alawi and concluded its statement saying "We demand the authorities to unveil his place, allow him to call his family and release him."
