Administrative Court Upholds Dismissal of Former Chief Executive of Chamber of Commerce

Bahrain Mirror: The High Administrative Court rejected lawsuit of the former chief executive of the Chamber of Commerce and Industry, in which he called for abolishing the decision of the Board of directors to remove him and the subsequent effects of the decision, explaining in his claim that he was the executive chief of Bahrain Chamber of Commerce under a contract signed in 26/12/2016 and he was surprised by a decision of the chamber's board of directors to remove him from his position in contravention of the provisions of the law.
However, the court confirmed that the provisions of articles 37 and 46 of Decree-Law No. 48 of 2012 concerning the Chamber of Commerce and Industry of Bahrain state that the chamber's board of directors is competent to exercise all the powers necessary to achieve the objectives of the Chamber and the conduct of its work, and in particular to appoint the chief executive and his deputies and terminate their services as defined in the executive regulation of the law, and that it is allowed to dismiss the chief executive from his post due his failure or incompetence to accomplish his duties or inability to perform them by a decision taken by one third of the board of directors.
The court added that the issuance of Decision No. (7) for the year 2018 by the Chairman of the Board of Directors of the Bahrain Chamber of Commerce and Industry to terminate the service of the plaintiff, under the authorization given to him by the General Assembly of the Chamber at its ordinary meeting held on 22/4/2018, came due to the invalidity of the work contract between him and the Chamber on 26/12/2016.
